1. Acceptance of Terms
By accessing our website and purchasing fine art prints from Deborah Heinlen Photography LLC ("DHP," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or purchase our products.
2. Products and Services
DHP offers fine art prints created from original photography by Deborah Heinlen. All prints are made to order and produced by our fulfillment partners. Product images on our website are representative of the final product but may vary slightly due to monitor settings and the nature of custom printing.
3. Pricing and Payment
All prices are listed in U.S. dollars and are subject to change without notice. We accept payment through our secure payment processor. By providing payment information, you represent that you are authorized to use the payment method provided. All sales are final once production has begun.
4. Orders and Production
Production begins immediately upon order placement. Production times vary by product type and are listed on each product page. We will notify you when your order ships. You are responsible for providing accurate shipping information. We are not responsible for delays or non-delivery due to incorrect addresses provided by the customer.
5. Shipping
We currently ship to the United States and Canada only. Shipping costs are calculated at checkout based on your location and order size. Once your order leaves our fulfillment partner's facility, we are not responsible for shipping delays caused by the carrier. Risk of loss and title for products pass to you upon delivery to the shipping carrier.
6. Returns and Refunds
All fine art prints are made to order and cannot be returned or refunded once production begins. Please review our complete Return Policy for information about our quality guarantee and procedures for damaged or defective products.
7. Copyright and Intellectual Property
All images, artwork, photographs, and designs sold by DHP are protected by copyright and remain the intellectual property of Deborah Heinlen Photography LLC. By purchasing a print, you receive only a physical copy for personal display. You do not receive any rights to reproduce, distribute, publicly display, create derivative works, or use the artwork for any commercial purpose.
Prohibited Uses:
Reproducing or copying the artwork in any form
Reselling or redistributing the artwork
Using the artwork for commercial purposes
Creating derivative works based on the artwork
Digital reproduction or scanning for any purpose
Removing or altering any copyright notices or watermarks
Violation of these terms may result in legal action and you may be held liable for damages, including attorney's fees.
8. Personal Use Only
All prints are sold for personal, non-commercial display only. If you wish to use our artwork for commercial purposes, editorial use, or any form of reproduction, you must contact us directly for licensing arrangements.
9. Quality Guarantee
We stand behind the quality of our products. If your print arrives damaged during shipping or has a manufacturing defect, please contact us within 7 days of delivery with photographic evidence. We will work with you to resolve the issue, which may include providing a replacement print at no additional cost. This guarantee does not cover damage that occurs after delivery or dissatisfaction with color, size, or style choices made during your purchase.
10. Order Cancellations and Modifications
Orders may be cancelled within 2 hours of purchase by contacting us directly. After 2 hours, production has begun and orders cannot be cancelled, modified, or refunded. We are not responsible for errors in your order if you provided incorrect information during checkout.
11. Limitation of Liability
To the fullest extent permitted by law, DHP shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
Your use or inability to use our products or services
Any unauthorized access to or use of our servers
Any interruption or cessation of transmission to or from our website
Any bugs, viruses, or other harmful code that may be transmitted to or through our website
Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted or transmitted through the website
Our total liability to you for any claim arising out of or relating to these Terms of Service or our products shall not exceed the amount you paid for the specific product giving rise to the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless DHP, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with:

Your violation of any third-party rights, including copyright or intellectual property rights
Your misuse of our products or artwork
13. Dispute Resolution and Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the Commonwealth of Kentucky, without regard to its conflict of law provisions. Any disputes arising from these terms or your use of our website shall be resolved in the state or federal courts located in Boone County, Kentucky, and you consent to the personal jurisdiction of such courts.
14. Right to Refuse Service
We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion, including but not limited to situations where we believe customer conduct violates applicable law or is harmful to our interests.
15. Modification of Terms
We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website.
